Affiliate Program Terms of Service

This agreement (“Agreement”) sets forth the terms and conditions for participation in the Affiliate Program (“Program”). By signing up as an Affiliate, you agree to comply with these Terms of Service.

Final One reserves the right to update or modify the Terms of Service at any time without prior notice. Any new features or tools that enhance the current Program will be subject to the Terms of Service. Your continued participation in the Program following any changes will be deemed as acceptance of those changes.

Violation of any of the terms below may result in the termination of your Account and forfeiture of any outstanding affiliate commissions earned during the violation. You agree to use the Program at your own risk.

Account Terms

• You must be at least 18 years old to participate in this Program
• You must be a human. Accounts created by bots or other automated methods are not allowed.
• You must provide your full legal name, a valid email address, and any other required information to complete the signup process.
• Your login is for one person only and cannot be shared between multiple users. unless otherwise agreed. 
• You are responsible for maintaining the security of your account and password. Final One is not liable for any loss or damage resulting from your failure to comply with this security obligation.
• You are responsible for all content and activity that occurs under your account.
• One individual or legal entity may not maintain more than one account.
• You may not use the Program for illegal or unauthorized purposes or violate any laws in your jurisdiction (including copyright laws).
• You may not use the Program to earn commissions on your own product purchases.

Links and Graphics on Your Site, Emails, or Communications

Once approved as an Affiliate, you will be assigned a unique Affiliate Code. You can place links, banners, or other graphics provided by Final One on your site, emails, or other communications. We will give you guidelines and tools for creating links and graphics.

To ensure proper tracking, reporting, and referral fee calculation, you must use the specific link formats we provide for all links between your site and Final One. Only sales made through properly formatted Special Links will qualify for referral fees. We are not responsible for failure to properly use Special Links or errors in typing your Affiliate Code, which may result in reduced earnings.

Affiliate links should direct customers to the specific product page you are promoting.

Referral Fees/Commissions and Payments

To earn a referral fee, the customer must complete a purchase through a Special Link from your site, email, or communication to https://final-one.com during that same session.

We only pay commissions on links that are tracked by our system. If a sale is not tracked by our system, we cannot pay commissions. Fraudulent, illegal, or questionable sales or marketing methods may result in the disqualification of commissions.

Commissions will only be paid after you’ve earned more than £30 in affiliate income. If you do not reach this threshold, your commissions will remain unpaid until the total crosses the £30 mark.

Identifying Yourself as an Affiliate

You may not issue any press releases or misrepresent your relationship with Final One. Any false claims or suggestions that Final One endorses you or your activities will result in termination from the Program.

You may not purchase products through your affiliate links for personal use, and doing so may result in the withholding of commissions or termination from the Program.

Payment Schedule

As long as your current affiliate earnings exceed £30, you will be paid monthly. If your earnings are below this threshold, payment will carry over to the next month until the £30 threshold is met.

Customer Definition

Customers who purchase through the Affiliate Program will be considered customers of Final One. As such, our rules, policies, and procedures regarding customer orders, service, and sales will apply to those customers. We reserve the right to change these policies at any time, including pricing and product availability.

Your Responsibilities

You are solely responsible for the development, operation, and maintenance of your site, including ensuring:

• Your site’s technical operation and its compliance with third-party agreements.
• The accuracy of all content posted on your site.
• Materials on your site do not violate third-party rights (e.g. copyright, trademark, privacy).
• Your site adheres to relevant laws and regulations regarding data collection and cookies.

Compliance with Laws

You agree to comply with all applicable laws while participating in the Program, including, but not limited to, data protection regulations, and anti-spam laws such as the GDPR and UK PECR.

Term and Termination

This Agreement begins upon approval of your application and remains in effect until terminated by either party. You or Final One may terminate this Agreement at any time, with or without cause. Upon termination, you must remove all Final One links and graphics from your site and stop using Final One’s trademarks.

Termination

Final One may, at its sole discretion, terminate your account for any reason. Termination will result in the forfeiture of any unpaid commissions and the removal of access to the Program.

Relationship of Parties

You and Final One are independent contractors, and nothing in this Agreement creates any partnership, joint venture, or employment relationship. You may not make any claims or representations on our behalf.

Limitation of Liability

Final One is not liable for indirect or consequential damages, loss of revenue, or data arising from this Agreement. Our liability is limited to the total referral fees paid or payable to you under this Agreement.

Disclaimers

We make no warranties regarding the Program or products sold through the Program. We do not guarantee uninterrupted service or error-free functionality.

Independent Investigation

You acknowledge that you have read and agree to all terms of this Agreement. You understand that Final One may offer terms that differ from this Agreement or operate websites that may compete with your site.

Arbitration

Any disputes arising under this Agreement will be resolved through confidential arbitration in the UK. Injunctive relief may be sought in UK courts for any violations of intellectual property rights.

Miscellaneous

This Agreement is governed by UK law. You may not assign this Agreement without prior written consent. Failure to enforce any provision of this Agreement does not constitute a waiver of that provision.

This Agreement constitutes the entire agreement between you and Final One concerning the Affiliate Program and supersedes all prior agreements.
